What will be my H1 status if DOL closes my employer business? How many days will I have to find a new employer? Kindly suggest me a way to get my salary with minimal impact to my H1 status. Thanks, Nag You are safe to transfer your H1B petition to any new employer if you file a complaint with DOL. This option is the one that will have minimal impact on your career in US. Link to comment
JoeF Posted April 28, 2014 Report Share Posted April 28, 2014 Filing a WH4 with DOL is your only option. DOL won't close the employer. They can't do that. What they can do is forcing the employer to pay you. Link to comment

hightech Posted April 29, 2014 Report Share Posted April 29, 2014 Don't delay complaint to DOL and transfer H1B to new employer. In most of the cases DOL will ask your employer to pay you can't close the business but it takes long time. Link to comment
