karan1981
Hi I have worked in US on H1 visa and for personal reason had to move back temp to India. While on H1 I had process my GC through employer which I transferred to consular processing. Now I have got notice to deposit $400 for processing. I am seeking advice for some of questions: - once consular approves GC what is the time line in which I have to travel to USA. - once in US can I file request to be out of US with USCIS to finish my existing project. Fee associated with it. - how long I can stay out of US. - If I get GC and cannot travel right now what can I do retain GC. Will really appreciate you time and help in advising. Thanks Link to comment
JoeF
You would get an Immigrant Visa, which is valid for 6 months. You have to enter during the validity time. When you enter with that Immigrant Visa, you get the GC stamp in your passport right at the POE. The actual card will arrive a few weeks later. Link to comment
t75
You can apply for a reentry permit and return home to complete your assignment only after you have it in hand. Link to comment
karan1981
Hi Thanks for your replies So you are saying that once I get the approval I have 6 months time to travel and that I don't have to travel immediately? Can you answer my other 3 questions: - once in US can I file request to be out of US with USCIS to finish my existing project. Fee associated with it. - how long I can stay out of US. - If I get GC and cannot travel right now what can I do retain GC. Link to comment
t75
Your questions have been answered. Read the USCIS website; if you do not understand, consult an attorney. However, do not expect to "bank" your GC for later use if you cannot comply with the rules. Link to comment
