Will my CAP get reset if i stay exactly 365 days outside USA?

Here is my scenario.

 

1. Reached USA on L1B Visa on  07/11/2009  
2. Left USA  on 11/19/2011 ( L1B expiring on 11/21/2011)

 

-- stayed outside USA for exact 365 days ( 2012 being a leap year ) --

 

3. Reached USA on H1B Visa on  11/18/2012 ( valid thru  sept-2015)

 

Please let me know if my CAP got reset on my re-entry in Nov/2012.

 

i am not sure if we consider the extra day we get in leap year in this scenario.

 

please help.

When was your H1B petition filed? If it was filed before 11/18/2012 the clock is not reset.

No, it didn't reset.

For the time to reset, the person would have to be abroad for a year before a new H1 can be FILED.
