L1 to H1B Conversion - Urgent

Hello All,

 

I am working for employer A on L1 and my L1 visa got expired on Mar 2014.

I have approved H1B petition from a consultant of last year so my employer A filed L1 to H1B COS on Apr 2014 and it on RFE.

 

1. How much response time we have to answer RFE?

 

2. I got one more offer from Employer X who is ready to file my H1B COS. Can he do that?

 

3. If COS from employer A was approved after filing H1B COS by employer X who it will be.

 

Can someone please clarify my question. This is but urgent.

You didn't mention the duration how long have been worked on L1.

 

1) It depends upon officer (some officers will give one or three months time).

2) Yes

3) It can be approve either any one or both but you have to decide to whom you want to join.

 

Why do you want to waste money even one petition is in pending and switch over other company

1. It will be mentioned in RFE document.

2. Yes.

3. Employer A and you have to wait for employer X's petition approval, if you want to join X.

I am very much worried that if RFE got denied I will be out of status. Thats why I am thinking to file from Employer X as well.
