dileepv_ms
Hi All, I had a F1 visa and moved into H1B visa in 2008 and is valid approved for 3 years. Unfortunately i had some issues with visa stamping and couldnt get back to US. my H1B visa is expired (Oct 2011). Now If my employer or some other employer will file a H1B for me, Does my H1B application needs to go through lottery again ??? or is it something that i already have approved H1B earlier, will it be a straight extension of such sorts. If my case doesnt go through lottery, what is the time frame within which my employer can file the H1B this year. Thank you for your time . Thanks, Dileep Link to comment
jairichi
You are cap exempt and an employer can file your cap exempt H1B petition anytime. Link to comment
opt_extension
Anytime your employer can file H1B for you and it need not to go through H1B lottery again, good for 6 yrs. Link to comment
