Yarra1 Posted April 6, 2014 Report Share Posted April 6, 2014 Hi , Thanks for advising us on the immigration issues . My I -94 expired on Oct 30th 2013 , But my extension got denied on 04/04/2014 . One of the employer told me that he can apply for H1B transfer (Premium) from current employer . My question are ... would that be possible to apply H1B transfer even If I don't have valid I 94? how long I can stay in US after the extension denied ? what are consequences if I stay in US till I get the some status on transfer ? If I go back to india Can I apply extension again ? Please help me by clarifying the question , Thanks in advance !!! Link to comment
rahul412 Posted April 7, 2014 Report Share Posted April 7, 2014 Currently, you are out of status.You can file for transfer but I guess it won't get approved. Better to leave US and file for transfer. What's the reason for rejection?? Link to comment

If I go back to India , Shall I go for new extension through the current employer instead of transfer ? what are possible chances of getting extension approved ? Link to comment

If denial is due to your employer credentials that cannot be rectified then there is no point in going for extension with current employer. Link to comment

You can either file for ext or transfer, that's up to you. Approval depends on the petition documents. Link to comment
