karmavatar Posted March 25, 2014 Report Share Posted March 25, 2014 Hi, My wife intended to go to Canada for two days and then re-enter US using Automatic Visa Revalidation. She has been on H4 since 2008 and has change of status to H1B from Oct 2013. She has not traveled to outside US since then and holds Indian passport and there is no H1b visa stamp on the passport. She has I-797, I-94. As long as she doesn't submit I-94 on her departure from US and show that on re-entry, I believe this is all good for her to re-enter from Canada to US without having to go for visa stamping in Canada. http://travel.state.gov/content/visas/english/g... But, above is not my question. The Problem - To make matter difficult, and unaware of above rule, she submitted DS-160 application form for interview at Calgary. But, she stopped right there. She didn't pay any fees nor did she schedule for a visa interview. The AVR website above says - "Applied for a new visa which has not yet been issued" Is submitting DS-160 form still considered "applying for a visa"? Or is it showing up for a visa interview at the consulate is considered in above statement? Can she still use AVR? I was able to the use the AVR successfully without ant issues...as the immigration for US happens in Canada itself most officers are aware of the Law. Just carried the - Factsheet attached in the the CBP link to be safe and was good to go. - https://help.cbp.gov/app/answers/detail/a_id/1218/~/automatic-revalidation-for-certain-temporary-visitors The CBP officers are usually very helpful and understanding if you have all papers clean so not to worry about using this rule. To be clear you can only use this if you have an expired Visa but an Valid I797 with I-94 which hasn't expired you are good to use the AVR. Thanks Link to comment
