H1B-OPT STEM Extension Clash

Hi,

 

I am currently on my 12-Month OPT which expires in June,14.

 

My employer is filing for my H1B. Just to be on the safer side I am also planning to file for my OPT-STEM extension in May.

 

If my OPT STEM Extension is approved after my H1B is approved, what status will I be in?

 

I specifically wanted to know if my OPT STEM extension decision is taken after October 1st.

 

Also how does Cap-Gap Stem extension affect this?

Then you will be on OPT STEM extension. Ask employer to file H1B petition with consular processing. This will help you to move to H1B status whenever you want after 1st Oct 2014.
