luck2u
One of my friend has some strange situation, here it is... My friend's I-140 with Employer X has been revoked after H1B was transferred to Employer Y (sister concern of Employer X). Currently my friend got PERM approved from Employer Y and they are filing I-140 in next two weeks. So now, can she transfer her H1B to Employer Z (nowhere related to Employer X and Employer Y) using Employer X's I-140 petition copy which was revoked even she don't have approved I-140 from Employer Y. Thanks in advance!! Link to comment

elkrishna
Hi Luck2u did your friend move to employer z and got the h1b transferred for the remainder period from employer Y? Please answer this will help me in deciding my move to the new comapny. I see lots of topics have same discussion but no one have concluded saying if they were successful or not . Link to comment
luck2u
@elkrishna: My friend did not transferred H1B to Employer Z. Even I'm hearing mixed answers-some say it can be transferred till validity of existing H1B period (though current H1B is beyond 6 years) and some say I-140 should be active to transfer H1B after completing initial 6 years of H1B period. luck2u
@elkrishna: In one of the thread I posted below few months back... I checked with my attorney and came to know that we can transfer H1B even I-140 is withdrawn but cannot get extension. Link to comment
