Would MFA degree qualify for a Masters Cap exempt for a Software Job?

Hi

     I have an MFA (Film Production) from a non-profit and accredited university (USC, Los Angeles) and a bachelor's degree in Computer Science from India. I have been offered a software engineer position and would like to know if  I still quality for the advance degree Master Cap exemption?

 

My apologies if it has already been answered somewhere. I have gone through all the Master Cap related guidelines, blogs and threads, but unfortunately I couldn't find the answer. I have called USCIS to inquire about this issue and waiting for their call. Wait time 90 min only :)

 

I would really appreciate if someone could advice. Thank you so much.

The masters degree doesn't have to be from the field, as long as the bachelor degree is from the field.

All that matters for the Advanced Degree quota is that the degree is from an accredited, public or non-profit private US university. USC, a well-known university, certainly fits that.

With a film production degree from USC, you are in famous company (George Lucas got his degree from USC: https://en.wikipedia.org/wiki/George_Lucas)

No. You do not even qualify for a H1B in general quota. You would need a 4 years bachelor's degree in a field related to H1B occupation.

For Master's cap exemption, you need to have master's degree directly related to your H1 job. In your case, you can't.

 

But since you have CS degree you are eligible for H1 s/w job .

The requirements for AD Cap are as follows:

 

(1) Employee should have acquired AD from a US accredited public school.

(2) The position requires advanced knowledge that is imparted of the advanced degree

 

In your case, even though you meet (1) you will not qualify for (2) and hence will result in rejection of petition, if applied in AD cap.

 

Please consult an immigration specialist to verify this.

Rahul412: I believe OP has a B.Sc degree in Computer Science which is a 3 year degree. I might be wrong unless OP clears it up for us.

That actually is not true.

For the Advanced Degree quota, all that is needed is that the advanced degree is from an accredited, public or non-profit private university.

Of course, the person needs to have at least a bachelor degree in the field, which here seems to be the case.

So, the OP does qualify for an H1, and the OP does qualify for the Advanced Degree quota.
