indianassault Posted March 12, 2014 Report Share Posted March 12, 2014 Hi, One big employer has identified a project for me in USA and he is willing to sponsor a new H1. He has offered in India and once I join I could go to US. Technically is it possible to file for H1 and go for stamping etc before the start date? Its how H1 works , but for India based offer is it still valid? I am concerned because. 1) The joining location is India, 2) Salary is quoted in INR. 3) So just filing an LCA is sufficient or I need a US based offer to be eligible for H1 filing. So want to know if they can proceed with filing with cap exempt H1 and I can go as far as stamping before joining them. Thanks. Link to comment
mj129 Posted March 13, 2014 Report Share Posted March 13, 2014 If you are working for the sponsoring company but located in India, for the time being, you should be working for them as a contractor and salary is will be in Indian currency, not USD. Link to comment
