Cap exempt h1b visa

Hi, I was in US during 2000-05 period and returned to my home country for good. Now I am planning to get back to US for job reasons and I have around 1.5 years to be recaptured of my initial 6 years H1b period.

 

My question is that whether I am eligible for h1b cap exempt processing since my last h1b visa expired 8 years ago (2006).

 

Please advice.

Yes, you are cap exempt and would get the remaining 1.5 years.

Hi, i got H1B Receipt on Apr-2007 and Visa in Jan-2008. i was in US during Aug-2008 to Mar-2010. My Visa has expired in Sep-2010.
