lpuname
Hi Experts, Can someone answer my queries..... My I-797B petition is valid from 10/1/2008 to 9/18/2011 which is over now Interview for H1B was held on 19 JUN 2009 at Hyderabad and 221g given on same day. Hyderabad consulate had sent memorandum explaining facts of 221g to US consulate on 12/14/10. After the above series of incidents, I had no communication from Hyderabad consulate. Later I have checked (too late) my H1b had approved on 4/27/2011 which is over now and deferred to Hyderabad consulate. Question 1: 1) my I-797B petition is valid only from 10/1/2008 to 9/18/2011, Is there any way to go for a stamping for this year. Question 2: 2) my I-797B petition is valid from 10/1/2008 to 9/18/2011 which is over, Is there any way or possibility to get the extension of Question 3: 3) If I apply for new h1b 2014, will my application comes under quota or exempted from the quota as I have had h1b approved which is not used on 4/27/2011. No. An employer can file a cap exempt H1B petition anytime and on approval you can apply for a H1B visa at US consulate and travel to US with I797. 2. Refer 1. 3. Refer 1. Link to comment
