redevil23 Posted February 19, 2014 Report Share Posted February 19, 2014 HI Everyone, I have a very interesting case. I got my first H1B for 3 years, efective Oct 2011 to Sep 2014. I went back to India on vacation in Jan 2012 but got stuck due to Visa Stamping issue. After numerous attempts by my employer I finally got my visa stamping after 2 years and got back to US in Jan 2014. My employer never applied for new visa, I cam back on my original I 797 . So, I wanted to know if I am eligible for new 6years of H1B as I have stayed outside US for more than 1 year or 2 years of my H1 has been wasted and I only have little less than 4 years left on my H1B. Please suggest. Thanks You are not eligible for new 6 years as the clock was not reset as you entered with the same H1B petition. You are eligible for 6 years - time spent in US on H1B status.
