Cap - Exempt H1B

I am on OPT and it expires in May 2014, My employer(board of education) where I am currently working  has decided to file my cap exempt h1b this month, and mentioned the start date as December 2014 for my new higher position(currently I am an Intern and my internship program here ends in December), my OPT expires in May 2014, If my h1b is approved, on what status will I be until December 2014? My employer(CPS) is not enrolled in E-Verify, so I cannot apply for an OPT extenstion. Please advise.

If your OPT is done by May 2014 on what basis can you work for employer?

For ext your employer has to be e-verified.
