When can I enter US and when can I start working

Hello,

 

I am currently in India. I have a H4 visa. I am going to apply for a H1B visa.

 

I am told that I would get the H1B approval form in May. (Is this correct?)

 

- Can I then enter US using H4 visa in June? But start working only in October?

- Can I enter US using H4 visa in June? And start working as well?

- Can I enter US only after October? With the H1B stamping?

 

Please let me know.

Depends on when you get approval. No specific date or month could be gives unless your employer files in premium processing.

You can enter US with a H4 visa in June. But, to start working from October either you need to exit and enter US with a valid H1B visa or employer files for COS from H4 to H1B and pays H1B fee again.

IF your H1B is approved, you may begin working only on Oct 1 at the earliest. Entry on H4 would require a COS to H1B before beginning work. Entry on H1B can be 10 days prior to approved start date.

You don't apply for H1...your employer does!! Who paid for your H1??
