My company is about to file GC for (PERM) in one or two months. My H1b Visa is expiring in March 2015 ( in a span of 1 year) I am currently under H1b extension from US itself. I need to travel India on some personal work and while coming back I need to go for consulate interview Is it safe to go India now since my H1b is under extension ? Will there be any rejections chances more at this situation? If rejected how many days I need to wait for second visa interview? OR should I need to travel after my labor certification or after I-140 approved I am confused lot on my travel whether should I go or not. Please advise so that I can take clear decision on my travel under H1B extension. Link to comment

Please advise so that I can take clear decision on my travel under H1B extension. As long as your current H1B petition is valid (I797) you can travel and get a H1B visa stamped in your passport. Chances of approval or denial are based on documents submitted at consulate. Also, if denied only based on the reason for denial one can say how quickly you can apply for new visa interview.
