But due to lack of positions they didnt send me for stamping and they are no positions also to travel to US from my employer in near future. So is it possible to transfer my H1B to other employer ? - I have all the petition approval documents with me. - Stamping is not done. Only petition papers are there with me. - I never travelled to us If I apply for transfer, is it possible for my employer to cancel or revoke my petition though the documents are with me ? Thanks Karthik An employer can file a cap exempt H1B petition and on approval with a valid H1B visa and I797 you can enter US and work. By law an employer has to revoke your H1B petition once you stop working for them. However this will not affect future cap exempt H1B petitions filed by prospective employers. Link to comment
