H1B Expired - Can it now be transferred to other employer

Hi,

 

I worked in US from 2006 to 2008 with H1B and i came back to india. I didnt go to US after that.

 

I'm still holding a H1B. But it is expired. VISA or I797 validity is upto Aug 2010.

 

Please let me know if my H1B can still be transferred to other employer.

 

Or do i have to apply for a new H1B (in that case, will my H1B come under exempt category or fall in the same CAP).

 

Please do clarify the same. I went thru the forums. But i didnt get the correct / exact answers.

 

Please do the needful as i'm planning to go to US with my family.
