Now If I am applying for a H1b visa I have only 1.8 years left since my clock clock is not reset for 365 days after returing to avail full 3 year visa. I know the Visa approvals usually happens in June & July My Question is : If I apply in April, Can I request for a Visa approval date (of my choice) beyond October 13th 2014 so that my clock will be reset and can have a 3 year valid visa ? For a fresh H1, the person has to be abroad for a year before the employer can file the H1. And if the quota is full by then, an H1 can't be filed, not even without COS, until the quota is open again. Link to comment
