!Urgent: L1B extension waiting for approval, can we apply H1B?

This is VERY Urgent as my visa is going to expire on Feb 26 2014.

 

Please help me with this question.

I am having L1B individual Visa (Valid till feb 26 2012). My company filed for extension (L1B Ext.)  and i am waiting for response.

 

I want to file for New H1B this year 2014.

I am not sure if i will get a response for my L1B extension before March 31st 2014.

 

Can i still apply for H1B through a different employer? Are there any Risks or problems if it is possible to apply for H1B?

It is not the visa expiry date but the I94 date that allows you to stay in US.

Yes, an employer can file a cap subject H1B petition.
