Applying OPT and H1B together

Hey,

 

I am graduating in May 2014. My employer is ready to file for H1B this May. But I am in doubt whether it will be selected in the lottery and I dont have an OPT extension.

 

1. Should I apply for OPT before my employer applies for H1B ?

2. Is it legal to apply for H1B before graduating ?

1. Better to apply for OPT as there is always a risk of not being selected in lottery.

2. Yes, only if your eligibility for H1B is not dependent on the current degree you are pursuing.
