h1 transfer while renewal is pending

Hi Experts,

 

1. I have H1 with my parent company and I applied for H1 renewal, I am past my I 94 validity. The renewal application has reached USCIS before expiry of I 94 validity.

2. Now I am looking to change my company. Can the new company apply for my H1 transfer while the H1 renewal with my parent company is pending.

Yes, new employer can file a cap exempt H1B petition. It i considered as a bridge application as your I94 has expired.
