L1 to H4 - need info

I m on l1 and my us assignment Will be completing in a month . I'm planning to apply cos from l1 to h4

My husband h1 is on extension and they applied his extn 5 months back and he is out of status now.
Can I apply cos here using his receipt number without going back to home country

If so when is the best time to apply. Is it 2 weeks before my last day or immediately?

He is not out of status. As a proper extension was filed in time it is under process. Yes, you could apply for COS to H4 based on his H1B extension receipt notice. 2 weeks before your last day should be enough.
