H1B Visa expired - haven't used

Dear all,

 

I did my Masters in USA and came back for H1B visa stamping in 2009 - got visa stamping (valid date 2009- sep 2011) - after Visa stamping I haven't  used the visa and dint go to USA because of some family commitments

 

so now my question is how do I get renewal for the same H1B visa - is this possible?

 

or Do I need to go again the whole process newly for H1B doccumentation?

 

kindly please let me know if there is any way to get renewd my visa.

Any employer can file a cap exempt H1B petition anytime. Once approved with a valid H1B visa and new I797 you can enter US and start working.

You need to ask thme when , they will do but when and in which catagory like EB1 or EB3 .

They will do it but what if they do in 6th year of ur H1B visa

Where does EB1 or EB3 fit in this post? There was no mention about GC process from OP.
