My marriage has been fixed in August and will need to travel back to India. 1. Can I travel to India?If yes, will I face any issues coming back? Also I have heard that H1B will be based on COS. Will there be any issues in re-entry? 2. If my H1B visa is approved in May, do I need to get H1B stamped in August? 3. I will have to get my wife back with me in August. Wiill she be on F2 or H4? Please clarify... 1. Yes. But, if your H1B petition is still in process then COS would be denied. So, if you would like to start working for employer from 1st Oct you would need to exit and enter US with H1B visa or employer files for COS and pay H1B fee again. 2. Not required. But, you can if you want to. 3. She needs to apply for a F2. Link to comment
