A limited number may qualify for a leave equal to that which would be granted a USC or LPR in the same situation. Just wanting to take a leave without pay places you OOS. If you qualify for a dependent status, COS to that. Link to comment

Their is no unpaid leave in H1. File for COS or leave US and enter again on H1. Link to comment

JoeF Posted January 27, 2014 Report Share Posted January 27, 2014 Unpaid leave while in the US is pretty much impossible nowadays. Blame the fraud consulting companies who forced people on an unpaid leave to illegally avoiding paying on bench. Link to comment
t75 Posted January 27, 2014 Report Share Posted January 27, 2014 Maternity leave is a valid reason if the employer does not provide paid benefit for USCs and LPRs in the same circumstances. When in doubt, OP, speak with HR and/or an attoney to confirm your benefit eligibility. Link to comment
