prateeksc Posted January 21, 2014 Report Share Posted January 21, 2014 Hi All, I came to US in Jun 2009 on H1 visa through Company A. I went back to India in Feb 2011. I came back to US in Apr 2011 on H1 visa through Company A. I changed to Company B in May 2012. I am currently working with Company B as of Jan 2014. Now I have got an offer from Company A in Jan 2014 and I will be hired in managerial role. My question is, Can the Company A hire me on an L1A visa as I have previously worked for Company A ? Can I change my status from H1 to L1A in this manner? Please let me know. Thanks. Link to comment
jairichi Posted January 21, 2014 Report Share Posted January 21, 2014 Do you fulfill the following requirements? If yes then employer can file L1A petition. To qualify, the named employee must also: Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States; and Be seeking to enter the United States to provide service in an executive or managerial capacity for a branch of the same employer or one of its qualifying organizations. rohang Posted January 21, 2014 Report Share Posted January 21, 2014 I think L* visa are for intra company transfer, which is not true in your case. You will have to be in thr India branch for atleast 1 yr then they can file L1A for you. Link to comment
