H1B Transfer - Got an RFE - Help Required.

HI,

 

I am currently working for a company A(Small Consulting company) and got my H1-B Approved and valid till Aug 2016. Last month I got an offer from a company B(Big4 Consulting company) and they had initiated my H1B Visa transfer via premium processing. Unfortunately my H1B Transfer petition got an RFE and Company B Is still working on documents. Not sure what exact documents USCIS has asked for though(As company B hasn’t yet shared the details with me).

 

Please find more details about the petition below.

 

Date Petition Applied: Dec 23,2013

Date USCIS Received: Dec 27,2013 (Acceptance)

RFE Date: Jan 7,2014.

 

Questions:

 

1)      How long does USCIS take to process after receiving required documents from Company B?. Sharing any Experiences/information would be appreciable.

 

2)      I have to travel outside USA in March,2014 for my marriage. I would require a H1B visa Stamping, as this is my first H1B Approval. My questions is, If Company B responds back to RFE by January end and USCIS take an additional 15 days for processing and my joining date with company B ends up sometime in Mid February. Is it fine If I go to attend H1B visa stamping in INDIA with only one pay stub from Company B and rest all from Company A.

 

3)      Can I plan to attend visa stamping interview in CANADA through Company A sometime soon, while my H1B Transfer with Company B is in RFE status?  What would be the circumstances?. Any information/Experiences would be appreciable.

1. Might be a month or more than that.

2. Yes, it is absolutely fine.

3. Yes, you can as you are still working for company A.  But, with your travel plans in March 2014 I do not think it will be possible as to get a Canadian visitor visa it would take at least a month plus.

I already have my CANADA visitor visa in hand. So If I plan to attend a Visa interview in CANADA, while H1B transfer is pending in RFE status. I hope It will not have any impact on H1B Transfer process or my visa stamping? As I want to start working for Company B9Big4 Consulting) once transfer gets approved. Please suggest.

Start looking for available dates at US consulates in Canada quickly as there is a possibility that dates might not be available. You traveling when a cap exempt H1B petition filed by a new employer in progress will not affect its outcome or visa stamping.

I have exactly same situation. I have initiated my tansfer with new employer (Premium Processing) and got RFE  last week. Attorney replied and status moved to Initial review this wednesday (1/15/2014). My employer says we will get approval(he is confident it will not be rejected) by the mid of next week.

 

(1) I also have to travel to India for wedding in Feb first week and will go for stamping in Feb last. If I join new company I will have only 1 paystub. My new employer says we will not required any paystub for stamping,there are other documents that will prove your job. Do you think I can go for stamping with new employer , new employer is mid side company (4000-5000 employee) and have decent name in market.

 

(2) Do you think I can resign from current company as soon as I get the aproval on portal or I should wait for the physical copy to appear.

 

(3) I can work for my current employer and go for stamping even though my transfer gets approved with new employer.

 

I am worried about stamping , my employer says stamping will be a formality, as they will provide all required documents.

 

Your suggestion please!!!!!!
