h1andGC Posted December 25, 2013 Report Share Posted December 25, 2013 I am planning to utilize the AC21 provision to change employers since my I-485 is pending (under EB2) and I have approved I-140 and EAD. I don't intend to apply H1 extension since I have the EAD (to avoid unnecessary expense to the future employer). My question: To utilize AC21, does it matter if the new job description doesn't have the required experience to qualify for EB2 ? Thanks for your help. Link to comment

This is generally determined by the responsibilities, and there is no hard restrictions on the requirements. Show your job description to a good lawyer who can compare and advise what you should send out. Link to comment
