hapatel Posted August 15, 2011 Report Posted August 15, 2011 My wife (H4)fater name in BC is different than in passport. Passport says xxxxxxbhai whereas BC says xxxxxxxxxkumar. Will this work or I need to get it changed? Any one had such situation in the past and got any RFE. Please advice.
rickie Posted August 16, 2011 Report Posted August 16, 2011 My spouse had her mother's name misspelled either in BC or passport. Since, getting a new BC was easier than getting a new passport, we got a new BC with the name matching the passport. Our 485 is pending since 4.5 months, no RFE yet ! Good luck!

rickie Posted August 17, 2011 Report Posted August 17, 2011 I don't know how they got it corrected. Her uncle got it done and I do not think it was a big deal. He got it done in just a few days (may be less than a week).

I doubt that anyone cares what it is in her passport. In fact, you don't even have to send a copy of her passport pages (other than visa/I-94) for I-485 processing.

Visa might have her father's name under the "Given Name" section. Will a mismatch over there cause any issues? I don't know.
hapatel Posted August 18, 2011 Author Report Posted August 18, 2011 @Belle, Yes the name is same. It differs only in the tile (for ex. Mr. V/S Shri; i.e. xxxbhai V/S xxxkumar). I am applying for I-485 along with me. Your advice is greatly appreciated. Thanks,

Well, if you don't know, why worry? If an RFE arrives (which is highly highly unlikely), then you will worry about it.

Please advice. u r not applying for her fahter , as long as her records are consistent it shoould be ok, in case ( remote chances) a RFE is issued get an affadavit with her father testifying the his correct name

What his attorney suggested to get affidavit from India on Stamp paper by father or mother stating that both name XXXXbhai & XXXXKumar is same & one person. If you search on google you may find the sample letter. Don't worry its not major point. In my case also my mother name is different then what is on my BC. its XXXkaben on passport but on BC its just XXXXben. So, I also submitted same kinda affidavit.
