SUGARH Posted December 15, 2013 Report Share Posted December 15, 2013 I got I-797B without I-94, issued at Dec/02/13 I-94 is still valid, until April 20, 2014. Visa from previous company is still valid as I-94. 1. Do I have to go out of US right away? or can I go back to hometown middle of Jan? 2. Can I go to Canada for interview and get a new visa? or extend I-94? 3. is there any possibility to get denied because I am out of status and still in here? 4. Do I need to apply H1B for extension again instead of going back to my hometown to get a new visa? thank you for your help. Link to comment
SUGARH Posted January 12, 2014 Author Report Share Posted January 12, 2014 called USCIS customer service and they informed me I can stay before the date I-94 expire. also I visited immigrant center, and they told me that i need to fill out I-539 form and submitted. I am kind of confusion because I-539 is not for H1B holder, but H1B holder's family. is there anyone who got extension by I-539 as H1B holder, even though you had already decision like i-797B?
