L1B to H1, 5th Year, I-140 Approved

Hi

 

I am on L1-B with employer A.

Employer A filed my GC and currently I-140 is approved.

My L1-B max out date is April 2015.

 

I want to get H1 B done by employer B on April 2014 and switch company in October.

 

 

Question:

  1. How long I will get my new H1 B?
  2. Are there any extension to H1 B allowed after April 2015?
  3. Is I-140 by employer A is valid with GC process by employer B?

Employer B applies for a cap subject H1B in April 2014 and you can start working only from Oct 2014 for that employer.

1. 2 years.

2. Based on approved I-140 you can get H1B extended beyond the given 2 years on H1B approved in April 2014.

3. Yes, as long as employer A has not revoked I-140.
