PERM Pending and completed six year

Hi,

 

My employer filed PERM Jan 2013 and it is pending as of Dec 2013, I exhausted H1B six year Dec 2013.

 

I filed Change of Status H1 to H4 Dec 2013 and now my current status is pending H4 (have H4 file receipt).

 

When can my employer file COS to move from H4 to H1?

Can employer file once PERM 365 days complete i.e. Jan 2014?
