However, I went for a stamping in early 2012 & it was "Denied" after Administrative processing. (I was in US from May'08 until Jan' 2011 on H1b with company A.) > My approved H1B petition from 'employer B' was valid until Oct 2012. I didn't go for a stamping on it. (I did not work for Employer B) 1) Please can an expert confirm if I am currently CAP exempt. Can employer C file for a 'New' Cap exempt petition/is H1B transfer an option I can currently pursue? 2) How long will 'I' be/was cap exempt for (mm/yy) given the specific details above? 3) If I am cap exempt can I expect can I be eligible for a full 3 yr H1b term again? 3) I would appreciate if you can also explain how cap exemption actually works. Thank you!! If you have not utilized 6 years of maximum allowed on H1B you are cap exempt. Link to comment
