Help Needed regarding 7th year extension for Profit organization

Hello ,

 

I need your advice  .

 

My Immigration Status:

 

• Master from "Profit Originattion" 
• Regular H1B applied and approved under Master Cap "May 2008"
• 140 approved under EB-2 with same employer "Aug 2013"
• H1B Extension need to be applied for above approved petition ( Regular H1B (2nd extension) , going to expired on Jul 15th 2014) before July 2014.

 

My Questions:

 

• Will there be any problem if i do extension at that time as it was applied through Profit organization university ? If no, will they consider extension on my I140 ?
• And If yes, then what would be good option to avoid that ?
• Can i apply new H1 for next 2014 Apr1st (and my current h1 is still july15th 2014) ?

 

Any answers to above questions are greatly appreciated .

3. Employer files a cap subject H1B next year.

1. When he can apply for that (Can he apply it in July 2014)?

2. Will there be any problem if he applies on Cap subject ?

1. April 2014 if you qualify for H1B in regular quota.

2. No, if all documents are good.

3. I doubt that. Wait for others opinion or talk to an attorney.

I am sorry I believe your employer can file a cap subject H1B petition only after you have spent 365 days outside US.
