bpk1997 Posted December 1, 2013 Report Share Posted December 1, 2013 mymother received green card on jun 19 2007. stayed from jun19 2007 to May 24 2009. 23 months. stayed from august 18 2009 to april 20 2010 8 months stayed from oct 16 2010 to may 18 2011. 7 months stayed from nov 72011 to 4jun 2012 6 months stayed from nov232012 to may28 2013 6 months stayingnow from nov 20 2013.. She received her green card june 19 2007. her five year anniversary was June 19 2012. She has not stayed more than 6months outside USA. she has established total 50 months fo stay in USA. she is eligible to apply for citizenship now??? please clarify. also she came now on nov 20 2013. does she need to wait for 3months to apply for citizenship. We are a little confused. it says 5 years after green card, and total 30months of stay out of the 5 years. but some say total physical stay should be 57 months. which is correct. please clarify thank you Link to comment
JoeF Posted December 2, 2013 Report Share Posted December 2, 2013 The physical presence needs to be 1/2 of the 5 years, so you'd have to count the days and divide that by 2. Counting the number of months doesn't necessarily work, due to the different number of days in the months. Also note that partial days count, so the day of flying out and the day of flying in count as days in the country. Link to comment
