H1 to B2

Hi,

 

My visa expired on OCT 20 2013, due to US shutdown i was not able to  do my H1 transfer.

So i applied for B2 on OCT 20 2013 later I have also applied for H1 transfer since USCIS accepted petitions delayed due to US shutdown.

 

1) Which visa will get approved first B2 or H1B ?

2) How long does it take for B2 to get approved ?

3) Will i have any problem since i have applied for both B2 and H1B ?

1. Could be B2.

2. Current processing time 4 months plus.

3. Yes, if B2 gets approved after H1B then according to last action rule you will be on B2 status and need to apply for COS to H1B or exit and enter US on H1B visa to work for employer.
