Can I consider my mom who visits (B1/B2 visa) and stays with me 6 months every year, a dependent for tax purposes, if she passes the IRS Substantial Presence Test? Anyone had any (good/bad) experience using their FSA / HSA contributions towards visiting parents/relatives? Thanks for any help or advice. Link to comment

I believe yes and I think it has to be 183 days to qualify for substantial presence in US. Link to comment
JoeF Posted November 22, 2013 Report Share Posted November 22, 2013 Actually, she is not allowed to stay with you for 6 months every year. A visitor has to be abroad more than in the US. She may end up getting denied entry. Link to comment
