Will it be the LCA Amount (65K) or Will it be the Amount that you get paid (78K). LCA Amount is the minimum amount for that position. In the Offer LEtter from Employer, they will give LCA Amount. Should we stick to that or should we say the 70% (Client Billing) for which I have the paystubs. What should we fill in DS Form and what should we say to VO? Thanks in Advance. maverickp Posted November 20, 2013 Report Share Posted November 20, 2013 Mention the actual salary that is equal to or greater than the amount on your LCA, in the DS-160 form.When asked in the visa interview, mention both, the salary as per the LCA and the actual salary that's more than it. You can mention the same amount in DS 160 or the actual salary you get paid as per your paystubs. Since, you will be carrying your paystubs and bank statements also for the interview. You can mention any amount. You can explain the amounts as actual salary paid and LCA amount if you are asked for an explanation by the visa officer. Link to comment

There can be possibility of more than what LCA claims based on extra hours etc..but LCA is what actually employer agreed to pay for the employee. What can be the best thing can be answered in this situation. Plain and simple -- the truth, nothing more, nothing less. If you worked extra hours, got a bonus, got a raise, got a promotion ... you are fine -- as long as you are truthful about the reason if asked about it. Do not ever make up something that 'sounds' right, better, etc. -- that is lying to an immigration official and can lead to a reentry ban. The law is that the amount stated on the LCA is the minimum the employer is committed to paying the employee. It does not preclude the employer paying more and does not have a maximum. You are worrying over nothing, just be truthful. Link to comment
