raohomepc
Hi, My fiance was working in the US on a H1B visa. She went to India to get stamped 6 months ago. But has been in administrative processing since then. The passport is with the consulate for close to 6 months now. We are getting married in December. Would it be a good idea to apply for a H4 when the H1B stamp is pending? What will happen to the H1B if a H4 is granted? Will it be cancelled? Link to comment

I believe she would need to withdraw her H1B application before applying for a H4 visa. Link to comment
Tjgarla
Yes the H1B will be cancelled . She can get the H4 stamped in india. Come back and reapply for the H1B, as she will not fall into quota anymore. Link to comment
