Eligibility for EB2

Hello Everyone,

 

I have Bachelors of computer Science(3)+Masters In Computer Science(2) years from India. And i have over 7+yrs(4India+3USA) of prior IT experience with current employer Total years of experience is 9yrs. Am I eligible for EB-2. 

 

Can any one tell me, because today my company filed my PERM under EB-3, i am fighting with them because i never thought i would comes under EB-3.

It's the job description that decides the EB category. It doesn't matter how many degrees you have.

Same case as yours 

I have 3 years -Bachelor's Degree completed in 2003

I have my PGD 2006-2009.

I have full time work experience from 2004 till date = Approx 9.yrs 4mnths.

 

I have been told by attorney that - I am eligbile to apply only for EB3

A three year degree may not qualify you for any employment based GC.
