Can a H4 be on a long time sick leave from his previous company with a sick pay according to his home country's labor law?

 

The sick leave even has been effective before he got the H4 and entered US.

 

Need your thoughts!

H4 is your legal status in US, so it doesn't matter whether you are working or on vacation in your home country.

That's correct, but OP is getting paid because he is on paid leave.

Yes，he had insurance. The reason why he can had a long time leave approved from his company is because he got a serious illness

Thanks! But I read some of the posts here saying that H4 cannot have the paid vacation or work from home in US. in my friend's case, he is not having a vacation but a legal sick leave with pay. That's my concerns

Hi JoeF, Thanks for your reply! I saw a lot of your reply in this forum and they're very helpful! My friend is taking the sick leave and not working at all! but I have concerns about the sick pay. The legal sick leave approved before H4 and is the sick pay legal for a H4 in US without any active work?

Be sure that his insurance will pay in the US or make sure he can be added to yours. Only the very wealthy can pay their own medical bills from their own pockets in the US.

Yes, and the concern is regard the paid leave..he doesn't work at all, the pay is based on the labor law and his contract in his home country..is it legal？
