COS F1-H4, initial review

Hello,

 

I have filed for Change Of Status from F1 to H4 in August 2013. Case is still in initial review. F1 has already expired a month ago. I am 4.5 months Pregnant.

 

USCIS current processing date is June 27.

 

Can I request USCIS to extend or grant me a permission to stay?

 

Please advice for other alternatives.

Till a decision is pending with USCIS you are on valid status in US.

F1 has expired and there is no expiry date on I-94.

 

What can I do in case COS gets denied?

No expiry date on I94? Strange. Are you done with your studies? If yes then if COS is denied then you need to exit and enter US with H4 visa.

My husband is planning to file for H1 extension this month end. Can he file for H4 with his extension or should we wait until we get my case answered?

Please advice.

Better to wait for an answer for your application unless his application is processed in premium processing. Why do you want to duplicate an application i.e. applying two times for COS from F1 to H4?

Hi Sai2013, 

 

Did you resolve this case ?. I'm on same situation. Currently on F1 (I can apply for OPT but i'm not considering OPT) and courses are ending by August end. I'm planning to apply for H4 this week. Your advice will help.
