kirti Posted November 13, 2013 Report Posted November 13, 2013 I am a single mom and am planning to travel to US for work. I would also like to take my son (2 years old) along with me. Though I have parted my ways with my husband, I have not yet been formally divorced. My husband doesn't support me in any way right now. With my married status, what kind of documents will I need from my husband for my son's H4 ? Is there some No Objection certificate required from the father for the visa ?

You need a copy of your husband's 1. H1B approval notice (I797) 2. I129 3. latest pay stubs. 4. passport 5. visa (if any) 6. I94.
omshiv Posted November 13, 2013 Report Posted November 13, 2013 It seems like the Mom would be on H1B. If thats the case her 2 yr old son would need her own H1 related documents. Husband's docs not required...the way I see it.

Otherwise, this would look like international child abduction.
