Stamping expired, Visa valid for only 4 months, Shd I travel?

Hi All,

My H1 visa stamping has expired and my work permit is valid till April 2012.

I need to travel to India in Dec.

I am little worried whether I will get visa stamped for 4 months or not. I mean technically I have valid work permit till April 2012 but will the consulate have any issues giving me visa?

What if I get my H1 extension done before I visit India?

My immigration lawyer is saying in that case the consulate might give me visa starting from April (start date of H1 extension) and hence I will not be able to come back till April.

Has anyone faced similar issue? Any suggestions?
