ch2004 Posted October 29, 2013 Report Share Posted October 29, 2013 Hi, ** Have expired H1 visa on Passport(Company A) ** Have approved H1 Extension I-797 till Aug 2014(Company B) I am planning to go Cancun, Mexico for a vacation of 3 weeks Nov 28 - Dec 18 with family. I learned about the AVR process after reading the websites. I got my tourist mexico stamped from MX consulate and planning to re-enter using AVR process. 1. I have a question on the AVR applicability while re-entering US. Are there any issues if I have expired visa from Company A and the extension from Company B while re-entering using AVR ? Note: The reason for this question is that at the port of entry I noticed in the forum that the CBP officer is checking whether working for the same company or not. 2. Any issues while entering with my spouse on H4(same scenario expired visa stamped and have valid I-797 till Aug 2014) ? Can anyone please advise, this helps a lot. Thanks in advance. Tjgarla Posted November 5, 2013 Report Share Posted November 5, 2013 I guess you need to get your stamping done if you have an expired US VISA . You need to get the stamping done in the US consulate with your current i-797. I recommend you going to Merida consulate. Link to comment
