PERM Filed with gap between jobs.

Hello all,

I filed for my PERM but there is about a 3 month gap between my previous and current job.

Has anyone been in this situation? did you get the PERM approved or did you have to do anything else?

Out of status time is always a potential issue for future immigration processing. I assume your new petition was approved for CP which you have done.

Why did you not worry about it at that time when it could have been prevented? Advise your employer so that the attorney is aware of the situation and is better able to forestall future problems.

Thanks for the reply. Yes, my new h1b petition was approved for CP. My attorney is aware of this.

is there anything that can be done for these circumstances or is it just up to the immigration officer handling my case?

You are fine. There was 3 month gaps in my case too.
