H4- H1B - I 94 issue

Hi ,

 

I am currently in US with an H4 visa.I applied for H1b through my employer and went of country to India.

We got an RFE and after returning back from india my attorney replied to the RFE with the  new I-94(h4 status).

Now my H1B is approved which started from Oct1st but got it with the Original I-94 when I first entered the country.

Is this an issue?  Let me know if you need any more information.

I believe you need to exit and enter with a H1B visa. Not 100% sure. Wait for other members opinion.
