khkmurthy Posted October 20, 2013 Report Share Posted October 20, 2013 Here is my current status:I came to USA on 22-Sep-2007 through L1 Blanket visa and worked on it until 30-Nov-2008 - 437 days(1 year, 2 months, 10 days)I applied COS from L1 to H1B and started working on H1B (I797 is validi from 24-Dec-2008) from 19-Jan-2009 until 30-sep-2013 - 1716 days(4 years, 8 months, 12 days)My latest H1-B(extension) is valid until 06/09/2014I did not travel outside US since I came to US in 2007. So there is no recapture period that I can retain.I did not start my PERM process yet.Here are My questions:1) Am I eligible to work until 06/09/2014?2) If I start PERM process now, will I be able to apply for an extension before 06/09/2014?Please suggest what I should do now. Do I need to go back to India (or) change my status to H4 based on my husbands H1B status (or) are there any other options to stay (and work) in US until I get an extension? Please suggest!!! Remainder time = 6 years - years spent on L1 and H1B. I believe you have less than 2 months from 1st Oct 2013. Wait for other members opinion Link to comment

My opinion is you need to exit US after total 6 years on L1 and H1B. There is no other option to prolong your stay in US. Talk to a good immigration attorney and get options. Link to comment

Please suggest!!! 2) No, PERM will not help you, as you have almost no time left. You will have to leave once you reach 6yr of ur total stay. One option can be apply L1A (in this case u might get 1 more year) , but it has different eligibility criteria. Link to comment
